Terms of Use

1. Purpose
These terms of use (the “Terms”) govern access to and use of the Podium platform, available at https://get-podium.com and through any of its applications (the “Platform”), published by Podium (“we”), reachable at contact@get-podium.com and on +33 7 66 06 88 94. The publisher's registration details are published in the Site's legal notice as soon as the certificate of incorporation is issued.
The Platform is an intermediation service connecting athletes, companies and event organisers with a view to entering into, tracking and reporting on sports sponsorship partnerships. It is intended to cover every discipline and opens progressively, one discipline at a time. Opening a discipline neither restricts nor conditions the application of these Terms to the others.
2. Definitions
“Athlete”: any natural person registered on the Platform as an athlete, represented by their legal guardian where they are a minor.
“Company”: any legal entity registered on the Platform in order to identify, sponsor or support Athletes or Events, whatever its form (commercial company, sole trader, association, federation, club, public body). The term covers what the Platform's interface calls a brand or a sponsor.
“Organiser”: any person registered on the Platform as an organiser of sporting events.
“Event”: any competition, race or sporting occasion presented on the Platform by an Organiser.
“User”: any Athlete, Company or Organiser holding an account.
“Deal”: any sponsorship, partnership or in-kind agreement entered into between Users following an introduction made through the Platform.
“Podium Score”: a proprietary indicator computed by Podium assessing an Athlete's sponsorship potential based, among other things, on their sporting results, audience, engagement and professionalism.
3. Acceptance and amendment of the Terms
Creating an account constitutes full and unreserved acceptance of the Terms. Podium may amend the Terms at any time; Users will be notified of any material change by any appropriate means (including email) at least thirty (30) days before it takes effect. Continued use of the Platform after that date constitutes acceptance; otherwise, the User may close their account free of charge before the change takes effect.
4. Registration and account
Registration is open to: (i) Athletes, natural persons of full age, or minors represented under the conditions of article 5; (ii) duly incorporated legal entities, whatever their form (commercial company, sole trader, association, federation, club, public body), registered as a Company or an Organiser and represented by a natural person of full age duly authorised to bind them.
The User undertakes to provide accurate, complete and up to date information, and to keep it so. The User is solely responsible for keeping their credentials confidential and for any activity carried out from their account. Only one account is allowed per person or entity; several members of the same team may however access one account, each with their own credentials and their own role.
Athlete accounts are subject to a verification procedure (identity, licence, record, audience data), which gives rise to the verification fee set out in article 8. Podium reserves the right to refuse, suspend or delete any account in the event of false or misleading information or of a breach of the Terms.
5. Minor Athletes
The Platform is open to Athletes who are minors, whatever their discipline, solely under the following conditions: (i) registration is carried out by a holder of parental authority, who accepts these Terms in the name and on behalf of the minor; (ii) the account is administered by that legal guardian, who remains the point of contact for Podium and for Companies; (iii) any Deal involving a minor Athlete is entered into by their legal guardian; (iv) the legal guardian warrants the accuracy of the information provided and compliance with the regulations applicable to the work and image of minors.
Podium may at any time require proof of the identity and standing of the legal guardian, together with their express consent to the processing of the minor's data, in accordance with the Privacy Policy. Failing that, the account may be suspended or deleted.
6. Description of the services
For Athletes: creation of a verified sporting profile (identity, licence, record), a shareable public page, generation of sponsorship packs and of their public page, a printable presentation mode, computation of the Podium Score and presence in the rankings, exposure to registered Companies, messaging with Companies and Organisers, tracking of outreach and of contractual deliverables, view statistics for the profile and the packs, delegated access for members of the same team, and drafting assistance from copilots built on artificial intelligence.
For Companies: search and identification of Athletes by discipline, category, territory, audience and Podium Score, access to published profiles and packs, first contact, management of a partnership portfolio, tracking of expected and delivered counterparties, a document space attached to each partnership, and a consolidated performance report.
For Organisers: presentation of events, introductions to Companies and Athletes, tracking of the partnerships attached to an event, and a report per event.
For everyone: multi-user accounts with distinct roles, email notifications, and access to account data under the conditions of the Privacy Policy. The exact scope of the features is the one described on the Platform on the day of subscription; some are reserved for the paid plans set out in article 8, and the offering may change under the conditions of article 3.
Podium acts solely as a technical intermediary. Podium is neither a sports agent within the meaning of articles L.222-5 et seq. of the French Sports Code, nor an agent, nor a party to the Deals, and guarantees neither that Deals will be concluded, nor their proper performance, nor any level of income or visibility.
7. Podium Score
The Podium Score is calculated automatically from data declared by the Athlete, data verified by Podium and public data (results, audience, engagement, professionalism). It is strictly indicative: it does not constitute advice, a financial valuation or a performance guarantee. Its methodology may change at any time. Any manipulation of the Podium Score (false data, purchased audience, falsified results) constitutes a serious breach of the Terms. Athletes may request explanations about their score or challenge it by writing to contact@get-podium.com, and obtain human review.
8. Financial terms
Athletes: (i) a verification fee of forty (40) euros including tax per year, payable when the profile verification request is submitted, then on each annual verification renewal. Creating an account and a profile is free; (ii) an optional Premium subscription of twenty-four (24) to twenty-nine (29) euros including tax per month depending on the plan and billing period chosen, as detailed on the Platform.
Companies and Organisers: an annual licence whose price, scope and term are those of the accepted quote. Prices for offerings aimed at professionals are exclusive of tax.
Commission: where payment for a Deal passes through the Platform, Podium receives a commission of three per cent (3%) of the Deal amount, deducted from the flows through the payment provider referred to in article 11.
Additional services: a fixed-price contract drafting service by a partner lawyer may be offered, at the rate stated at the time of ordering.
Prices may be revised subject to at least thirty (30) days' notice before the next renewal date; the User may terminate before the new price takes effect. Any payment default may lead, after notice has remained without effect, to suspension of the account.
9. Term, renewal and termination of subscriptions
Subscriptions and licences are entered into for the term indicated at subscription (monthly or annual) and renew automatically for identical periods. Users may terminate at any time from their account or by email; termination takes effect at the end of the current period, without pro-rata refund unless otherwise required by law. For consumer Users, the information on automatic renewal required by the French Consumer Code (Articles L.215-1 et seq.) is provided before each renewal.
10. Right of withdrawal (consumers)
Consumer Athletes have fourteen (14) days from subscription to withdraw without giving reasons, by writing to contact@get-podium.com or using the standard form available on request. Where the consumer requests immediate performance of the service before the end of this period, they acknowledge that: (i) in the event of withdrawal, an amount proportional to the service already provided remains due; (ii) the right of withdrawal is lost where the service has been fully performed before the end of the period with their express consent.
11. Intermediated payments
Payments made on the Platform (verification fees, subscriptions, licences, Deal amounts) are processed by Stripe, an authorised payment services provider, which alone is entitled to collect and, where applicable, hold funds on behalf of Users. Podium never holds third-party funds.
From the public opening of the Platform, Stripe processes both Athlete verification fees and subscriptions. Collection of Deal amounts between Users is opened progressively.
Use of the payment services is conditional on accepting Stripe's terms and on verification of the User's identity under anti-money-laundering obligations, known as KYC. Card details are entered and stored by Stripe alone: Podium never has access to them.
12. Non-circumvention
During the use of the Platform and for twelve (12) months after account closure, Users shall not conclude, directly or indirectly, off-Platform, any Deal with a User where the connection was initiated through the Platform, for the purpose of avoiding the commission set out in Section 8. Any circumvention makes the commission immediately payable on the amount of the relevant Deal, without prejudice to account termination and damages.
13. User obligations and content
The User undertakes to use the Platform in good faith and in accordance with the law. The following are prohibited in particular: publishing unlawful, defamatory, disparaging or infringing content; communicating falsified sporting results or audience data; abusive solicitation; any attack on the security of the Platform; extracting or substantially reusing Podium's database.
The User remains the sole owner of the content they publish (photos, record, logos, descriptions) and of the rights attached to it. Podium acquires no ownership right over that content.
In order to display it, the User grants Podium a non-exclusive, free, worldwide licence strictly limited to the following: hosting, reproducing, technically adapting (resizing, format conversion) and displaying that content on the Platform and on the public pages the User themselves chooses to publish.
Any other use, in particular quoting a User or their content in a Podium communication (marketing site, social networks, sales material), requires their prior and express agreement, revocable at any time and without cause.
The licence ends when the content is withdrawn or the account is closed, subject to the time technically required for the deletion to propagate and to backup copies, purged according to the periods stated in the Privacy Policy. The User warrants that they hold the rights necessary over the content they publish.
14. Intellectual property
The Platform, the “Podium” trademark, the Podium Score, software, databases and graphic elements remain the exclusive property of Podium. The Terms do not transfer any intellectual property rights to Users.
15. Personal data
The processing of personal data carried out by Podium is described in the Privacy Policy available on the Platform, which forms an integral part of the contractual relationship.
16. Liability
Podium is bound by an obligation of means (best efforts). Podium does not guarantee continuous, error-free access to the Platform, which may be interrupted for maintenance, updates or force majeure. Podium is not liable for: (i) content published by Users; (ii) the conclusion, performance or non-performance of Deals, which are the sole responsibility of the parties thereto; (iii) services provided by third parties (payment provider, partner lawyer). Except in cases of gross negligence or wilful misconduct, personal injury or mandatory legal provisions to the contrary, Podium's total liability towards a business User is limited to the amounts actually paid by that User to Podium during the twelve (12) months preceding the event giving rise to liability. This limitation does not apply to consumer Users.
17. Suspension and termination by Podium
In the event of a breach of the Terms, Podium may suspend or terminate the User's account after formal notice remaining without effect for fifteen (15) days, except in the event of a serious breach (fraud, unlawful content, Podium Score manipulation, circumvention) justifying immediate suspension or termination. Amounts due remain payable.
18. Miscellaneous
If any provision of the Terms is held invalid, the remaining provisions remain in force. Podium's failure to enforce a breach does not constitute a waiver. The Platform's records and logs constitute evidence between the parties, who accept this evidentiary agreement. Podium may assign the Terms in connection with a transaction involving its share capital or business, subject to informing Users.
19. Governing law and disputes
The Terms are governed by French law.
In the event of a dispute, the User is invited to contact Podium first at contact@get-podium.com in order to seek an amicable solution.
In accordance with articles L.611-1 et seq. of the French Consumer Code, a consumer User may refer the matter free of charge to a consumer ombudsman. The contact details of the ombudsman appointed by Podium will be published on this page as soon as the appointment is made, and are provided on request at contact@get-podium.com.
Failing an amicable resolution, the French courts have sole jurisdiction. For professional Users, exclusive jurisdiction is granted to the courts of the place of Podium's registered office, notwithstanding multiple defendants or third-party proceedings.
